1. Agreement to These Terms
This website is operated by AL TOQUE VENEZUELAN FOOD LLC, a Venezuelan arepa kitchen and catering counter with its business address at 142 W 4450 S APT 201, Murray - 84107-3336, United States (US). The developer name under which this website is published is Al Toque Food. When these terms refer to the Company, we, us or our, they mean AL TOQUE VENEZUELAN FOOD LLC.
By visiting this website, by sending a message to the counter, or by placing an order, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the website and do not place an order. These terms apply together with our Privacy Policy, which describes how we handle personal information.
These terms cover every page of this website, including the homepage, the services page, the contact page and the legal pages. They also cover every order for arepas, cachapas, empanadas, weekend party trays, lunch combos, event catering and cooking classes that we agree to prepare. Where a written confirmation for a specific order states a different term, that term applies to that order and takes priority over a general statement in these terms.
We may ask you to confirm that you have read these terms before we accept a large order, a catering counter or a cooking class booking. A confirmation of that kind is a record that both sides understand the arrangement and does not change the meaning of any section below.
2. Eligibility and Capacity
You must be at least eighteen years of age, or the age of majority in your jurisdiction, to place an order with the kitchen. By placing an order you confirm that the information you give us is accurate and that you have the authority to enter into this agreement. If you place an order on behalf of a company or an organization, you confirm that you are allowed to accept these terms for that organization.
We may ask for reasonable confirmation of an order, such as a phone number or an email address, and we may decline an order if we cannot confirm that a request is genuine.
3. Our Services Described
AL TOQUE VENEZUELAN FOOD LLC prepares and sells Venezuelan food and related teaching services. Our services include arepas and cachapas, weekend party trays, empanada batches, lunch combos, catering for events, and cooking classes. Each order is described on this website or agreed in writing through the contact counter before it is prepared.
Because our food is prepared by hand and pressed to order, minor variation in size, color and appearance is normal and is a natural feature of fresh cooking rather than a defect. We aim to keep every item consistent, but we cannot promise that two hand pressed arepas will look exactly alike.
A description on this website is given to help you choose. Where a photograph shows a plate or a tray, the presentation is an example and the final arrangement may differ slightly because fresh ingredients vary. The written confirmation that we send for your order is the authoritative description of what the kitchen will prepare for you.
We may add a new item or retire an item from the menu as the seasons change. A change to the menu does not affect an order that was already confirmed, and an item that is no longer offered is not owing to a guest who has not yet placed an order for it.
4. Placing an Order
You may place an order by using the contact form on this website, by writing to orders@altoquefood.hair, or by calling +12236237591. An order is only accepted when we send you a confirmation that states the items, the quantities, the price, the date and the pickup or delivery arrangement. Until that confirmation is sent, no contract exists between you and the Company.
We may need to ask clarifying questions before we confirm an order, for example about a filling, a dietary need or a serving time. Please answer these questions promptly so that the kitchen can plan the batch and reserve the griddle for your order.
5. Pricing and Payment
Prices are quoted when an order is confirmed and may depend on the item, the quantity, the date and the location of an event. We may require a deposit for a weekend party tray, a catering counter or a cooking class so that the date and the ingredients are reserved. The balance is due as stated in the confirmation or at the time of pickup or service.
We may accept payment by the methods we announce at the counter or in writing. We do not store full card numbers on this website. If a payment is declined or a deposit is not received by the agreed time, we may release the date and cancel the order without liability.
6. Cancellations and Changes
You may request a change or a cancellation by writing to orders@altoquefood.hair as early as possible. Because ingredients are bought and masa is planned for a confirmed order, the following rules apply. A change or cancellation made well before the preparation window may be accepted with little or no charge. A change or cancellation made close to the preparation window may lose part or all of a deposit to cover ingredients and reserved time.
If we must cancel an order for a reason within our control, we will tell you promptly and we will refund any amount you have paid for the canceled items. We are not responsible for a delay or a failure caused by an event outside our reasonable control, as described further below.
7. Pickup and Delivery
Most orders are collected at the counter at 142 W 4450 S APT 201, Murray - 84107-3336, United States (US). Short local delivery may be arranged for selected items around Murray. Event catering may bring a travelling counter to your venue. The pickup or delivery time in the confirmation is an estimate made in good faith.
Once an order is handed to you or to a delivery partner, the risk of loss passes to you. We are not responsible for food that is left unrefrigerated or reheated incorrectly after it has been collected.
If you are not able to collect an order at the agreed time, please tell us as early as you can. We will hold a hot order for a short period where it is safe to do so, but we cannot keep freshly pressed food warm indefinitely without it losing quality. An order that is not collected within a reasonable time may be discarded, and a payment for that order may not be refunded.
When we deliver or when a catering counter is set up at your venue, you agree to provide safe access, a suitable surface and enough space for the service. A delay caused by a locked door, a missing access code or an unsuitable location is not a breach by the Company.
8. Food Allergies and Dietary Needs
Our food is prepared in a working kitchen where corn flour, dairy, eggs, wheat, soy, nuts and other allergens may be present. Even where we take care, we cannot guarantee that any item is completely free of a particular allergen. If you have an allergy or a dietary requirement, you must tell us in writing before the order is confirmed.
You are responsible for informing your guests about the contents of an order and for checking the labels we provide. If a guest has a severe allergy, please discuss the risk with us in advance so that we can advise on what the kitchen can and cannot safely prepare.
9. Cooking Classes
A cooking class takes place at the counter or at a location we agree in writing. A place in a class is confirmed when any required deposit is received. A participant should follow the safety guidance given by the instructor, including care around hot surfaces, hot oil and sharp tools. Participants take part at their own risk and should wear suitable clothing.
Recipes and written materials given as part of a class are for personal use at home and may not be republished or sold without our written permission. A class may be rescheduled if too few places are filled, and any amount paid for that class will be refunded or carried to a new date at your choice.
10. Intellectual Property
The content of this website, including text, images, layout, the name AL TOQUE VENEZUELAN FOOD LLC, and the visual design of our pages, is owned by the Company or is used with permission. You may view the pages and print a copy for your own reference.
You may not copy, republish, sell or redistribute any part of the website for a commercial purpose without our written permission. You may not use our name or our branding in a way that suggests a partnership or an endorsement that does not exist.
11. Acceptable Use of the Website
You agree to use this website only for lawful purposes. You will not attempt to gain unauthorized access to the website, to interfere with its normal operation, to submit false orders or messages, or to upload any code that could harm the website or another user. You will not use the contact form to send spam or unlawful content.
We may block access or refuse an order if we believe that the website or the kitchen is being misused. We may also report a serious matter to the appropriate authority where the law requires it.
12. Disclaimers
This website and its content are provided on an as available basis. We work to keep the information accurate and the website working, but we do not promise that the website will be uninterrupted, timely or free of error, and we do not promise that every description is free of a minor mistake.
To the fullest extent that the law allows, AL TOQUE VENEZUELAN FOOD LLC disclaims all warranties, whether express or implied, including any implied warranty of merchantability or fitness for a particular purpose, except where a warranty cannot be excluded by law.
13. Limitation of Liability
To the fullest extent that the law allows, AL TOQUE VENEZUELAN FOOD LLC is not liable for an indirect, incidental, special or consequential loss, or for a loss of profit, a loss of data or a loss of goodwill, that arises from the use of this website or from an order.
Where liability cannot be excluded, our total liability for a claim connected with an order will not exceed the amount you paid to the Company for that order. Nothing in these terms limits a liability that the law does not allow us to limit, including a liability for fraud or for a matter that cannot be waived.
A guest is responsible for the safe handling, storage and reheating of food after it leaves the counter. A failure to follow the reheat note, or a decision to leave food at room temperature for an extended period, is outside our control and is not a matter for which the Company is liable.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. If a rule of that kind applies to you, a part of this section may not apply to your situation, and the remaining parts will continue to apply to the fullest extent that the law allows.
14. Indemnity
You agree to indemnify and to hold harmless AL TOQUE VENEZUELAN FOOD LLC, its members, employees and agents from a claim, a loss, a liability or an expense that arises from your breach of these terms, your misuse of the website, or your unlawful act or omission. This obligation survives the end of any order or the end of your use of the website.
15. Force Majeure
We are not responsible for a delay or a failure to perform an order that is caused by an event outside our reasonable control. Such events include a natural disaster, a severe weather event, a fire, a power failure, a labor dispute, a shortage of a key ingredient, an act of a public authority, or a public health emergency.
If such an event occurs, we will tell you promptly and we will work with you on a reasonable solution, which may include a new date, a substitute item, or a refund of an amount paid for an order that we could not complete.
We will keep a record of the event and of the solution we agree with you so that both sides have a clear understanding of what happened. A force majeure event does not cancel an obligation that arose before the event, such as a payment for an order that was already delivered.
16. Governing Law
These terms are governed by the laws of the State of Utah and the applicable laws of the United States (US), without regard to a conflict of law rule. Any dispute that cannot be resolved by discussion will be handled in a court of competent jurisdiction located in Utah, unless a law requires a different forum.
Before starting a formal proceeding, we ask that you contact us at orders@altoquefood.hair so that we can try to resolve the matter directly and in good faith.
If a court or a tribunal finds that a part of these terms is not enforceable, that part will be adjusted to the smallest extent needed to make it enforceable, and the rest of these terms will remain in full force. A decision to delay or not to enforce a term on one occasion does not mean that we give up the right to enforce that term on a later occasion.
These terms represent the whole agreement between you and AL TOQUE VENEZUELAN FOOD LLC about the use of this website and about a general order, and they replace any earlier discussion on the same subject that was not written into a confirmation.
17. Changes to These Terms
We may update these Terms of Service from time to time so that they stay accurate as the kitchen grows and as the law changes. When we make a change, we will update the date at the top of this page. If a change is significant, we will take reasonable steps to bring it to the attention of guests who have an open order or an open conversation with us.
Your continued use of the website after a change means that you accept the updated terms. If you do not accept a change, please stop using the website and do not place a new order.
A change to these terms does not apply backwards to an order that was confirmed and paid for before the change. The terms that were in force when an order was confirmed continue to govern that order, even if the published terms are updated later.
